1. Agreement to Terms

By using our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Sellable provides AI-powered tools to help homeowners, real estate agents, and property managers sell properties more effectively. Our services include AI listing generation and auditing, an AI phone agent for handling buyer inquiries, SMS integration for lead communication, and Google Calendar integration for scheduling property viewings. The service is provided on an "as is" and "as available" basis.

3. User Accounts

To access our services, you must create an account. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. User Conduct

You agree not to use the service for any unlawful purpose or in any way that might harm, disrupt, or impair the service. You agree not to misuse our services by knowingly introducing viruses, trojans, or other material that is malicious or technologically harmful.

5. Third-Party Integrations

Our service integrates with third-party platforms including Google Calendar (via Nylas), Telnyx (phone and SMS), and others. By connecting your accounts, you authorize Sellable to access and use data from these services solely to provide the features described in Section 2. Your use of third-party services is also subject to their respective terms and privacy policies. You may disconnect any integration at any time from your dashboard settings.

6. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of Sellable and its licensors.

7. Limitation of Liability

In no event shall Sellable, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

8. Refund Policy

Right to Cancel (Consumers Only): If you are a Consumer, you have the right to cancel this Agreement and return the Product within 14 days without giving any reason. The cancellation period will expire after 14 days from the day after completion of the Transaction. To meet the cancellation deadline, it is sufficient that you send us your communication concerning your exercise of the cancellation right before the expiration of the 14 day period.

To cancel your order, you must inform us of your decision. To ensure immediate processing, please do so by contacting us at info@sellabl.app. Please note that in respect of subscription services your right to cancel is only present following the initial subscription and not upon each automatic renewal.

Exception for Digital Content and Services: By purchasing our digital analysis service, you expressly consent to the immediate performance of the contract and acknowledge that you will lose your right of withdrawal from the contract once the service has been fully performed (i.e., the analysis is generated, listing content is optimized, or AI phone services are utilized).

• Unused Services: You may request a full refund within 14 days of purchase if you have not yet generated an AI property analysis or used any of our AI-powered features.
• Technical Issues: If you experience technical issues that prevent you from accessing the service, please contact us within 14 days of your purchase.
• After Service Delivery: Once you have generated an AI property analysis, received AI-optimized listing content, or utilized our AI phone answering service, the service is considered delivered and the right to cancel is lost.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms of Service on this page.

10. SMS Messaging Terms

By enabling SMS notifications and providing your phone number through Sellable's onboarding or settings flows, you agree to receive text messages from Sellable regarding buyer leads, property listing activity, viewing reminders, and account alerts. Consent to receive SMS messages is not a condition of purchase.

• Program name: Sellable SMS notifications and alerts.
• Message frequency: Message frequency varies based on buyer inquiries, listing activity, and system alerts.
• Pricing: Message and data rates may apply.
• Opt-out:You can opt out at any time by replying "STOP" to any message we send. After you send "STOP," we will send a confirmation message and you will no longer receive SMS messages from that program unless you opt in again.
• Help:Reply "HELP" for help or contact us at info@sellabl.app.
• Carrier liability: Carriers are not liable for delayed or undelivered messages.
